Stud Services Agreement
Stud Dog:
Brood bitch: ___________________
1.) STUD SERVICES: The Kennel Les Anges Gardiens agrees to
provide the stud services of the Stud Dog referred to above
for the bitch mentioned above for a period not to exceed _____
days commencing on the date of this contract. The Kennel will
use reasonable efforts to obtain an actual mating (and "tie")
of the Stud Dog and Bitch. No guarantee is made, however,
that a tie will occur or that the bitch will become pregnant
or have puppies or that any puppies will live. It is the responsibility
of the bitch owner to ensure that the bitch arrives at Kennel
at the appropriate time to be bred. (Progesterone studies
and vaginal cytology are strongly encouraged to ensure optimum
breeding time.)
2.) STUD FEE: The Fee for the stud services is $850.00, payable
on the date of this contract. If no tie occurs, and the client
have provided a progesterone test indicating ovulation, the
Stud Fee will be refunded. If a tie occurs, the Stud Fee will
not be refunded in whole or in part. If a tie occurs but the
bitch fails to become pregnant (in whelp), the owner of the
Bitch must notify the kennel in writing not later than 100
days after the date of this contract. A return service will
be given to the same Brood Bitch without charge, at the next
heat and only the next heat. Unless such notice is given,
the right to a return service is forfeited. If the Stud Dog
dies or is sold prior to the return services, the bitch can
be mated with the kennel’s other stud.
3.) SHIPPING COSTS: Stud Fee does not include shipping charges.
The owner of the Bitch is responsible for all shipping charges
to and from the Kennel for the initial stud service and for
any return stud service.
4.) NEGATIVE BRUCELLOSIS: Absolutely no mating will take place
without a current copy of a Negative Brucellosis from the
brood bitch.
5.) BROOD BITCH: Must be at least 18 months of age, registered
with her country of residence Kennel Club, be certified free
of hip and elbow dysplasia, have current proof of immunity
against rabies, parvovirus and distemper as well as be within
the FCI breed standard in terms of temperament and conformation.
6.) BOARDING: The $850.00 Stud Fee includes the cost of boarding
the Bitch at the Kennel during the initial period of stud
service if the owner of the Bitch requires such boarding (up
to 7 days, after which Bitch owner will be charged a $10.00/day
board.).
7) LIMITATION OF LIABILITY: While the Bitch is on the premises
of the Kennel and with respect to transportation and boarding
services referred to above, the Kennel agrees to exercise
reasonable and customary care. SO LONG AS THE KENNEL SHALL
HAVE EXERCISED REASONABLE AND CUSTOMARY CARE, THE KENNEL SHALL
NOT BE LIABLE FOR ANY LOSS OR DAMAGE TO THE BITCH FROM DISEASE,
DEATH, RUNNING AWAY, THEFT, FIRE, INJURY FROM OTHER DOGS,
PERSONS, OR PROPERTY, OR ACTS OF GOD OR UNAVOIDABLE CAUSES,
NOR SHALL THE KENNEL BE LIABLE FOR ANY LOSS OR DAMAGE TO PERSONS,
PROPERTY OR OTHER DOGS CAUSED BY THE BITCH.
Buyer agrees that he/she understands this contract fully.
At the request of the buyer, this contract is written in the
English language.
